chatting with another taxi driver tonight re bald tyres, he reckons that the driver gets 3 points for a bald tyre (which i agree with) but he also says that if the taxi is owned by someone else and its caught with a bald tyre not only does the person drivin the car get 3 points but so does the owner of the car even if there not drivin it , is this correct , i thought it was whoever was drivin it at the time was responsible for checkin the cars condition for legallity :?

the person who is driving the car is responsible for the tyres not the owner of the cab who ever told you that is talking out his arse im a cab driver to

in a really bad situation a company can get done as well as the driver

 

like years ago when that lorries brakes failed and it crashed into a shop

 

both driver and company got done

 

but if you got pulled over with a bald tyre its 3 points for the driver :thumbsup:

The owner of a company vehicle CAN be summonsed for the offence of permitting the use of a vehicle with a defective tyre. Check out offences in relation to Use, Cause and Permit an offence.

So it is down to the driver and the owner of the vehicle to ensure that the vehicle is in a roadworthy condition.

this taxi driver uses this taxi 24/7 , the owner doesnt use it , surely the driver has resonsibility to make sure the tyres are legal, the owner never gets to check the car , for example i rent my taxi from a doris who doesnt even drive, it was her husbands and he left the taxi and plate to her when they divorced and i just pay her a rent to use it 24/7 , surely if i got caught with a bald tyre its my responsibilty not hers ,

If the vehicle is owned by the company, then the offences of use, cause and permit could be applied to the owner of the company,

Yesterday I stopped a van owned by a Hire Company, the vehicle was unroadworthy, so the driver was reported for the offences, the company will also be reported even though the vehicle is on a long term lease and has not been seen by the company for over 6 weeks

I worked for a firm who wanted me to use a defective van. I refused as I knew I would be held liable for any fines or points. They sacked me :lol:
