dont think its illegal but if it does affect your driving they'll have you for driving without due care or dangerous driving if you cause an accident whilst smoking

it is if youre in a work vehicle ie if your a lorrie driver or taxi driver etc

 

but not in your own car

Technically, I think anything that takes your hand off the wheel and is not a function of the operation of the vehicle is classed as not being in proper control of the vehicle. But I may be (and often am) mistaken :wink:

Kinda right, you have to prove that the driver was not in proper control, so the way I see it, is that you have to have 2 things in order to commit the offence, 1, the driver doing something that stops them being in proper control, ie: hand off the wheel, smoking, drinking something like that, BUT ALSO do something that shows you were not in proper control, swerve across the road, hit a kerb. That shows the court that the driver was not in proper control.

The best one I saw was a guy eating a full chinese meal, with knife and fork of a plate on the M20 at 70mph, resting the plate on the steering wheel :roll: , he still didn't see the problem with it, even after I spoke to him about it

I don't put smoking and driving in the same bracket as using a mobile phone, but if a driver started smoking whilst I was the passenger, I would ask to pull over as I am now used to having clean clothes and love it. A hatred of mine on a night out was passive smoke all over me. Yuk. Feels a lot healthier too now the ban is in force.
