1300 sport Posted June 3, 2009 Report Posted June 3, 2009 Came in from work last night to be greeted with a letter from the councils estate inspector (or what ever she is) telling me I must remove my car from outside the house. It's a rolling shell that I'm welding up as and when I can and is covered with a tarpaulin. She came out with different reasons why it's got to go. She even dealt the health and safety card. I've got no where else to put it and it nearly ended up on the bay last night,then I thought long and hard and have decided she can KISS MY ARSE I'm putting a fence up to hide it.

Address each point constructively and, where possible, backed up with facts. I hate it when people throw "Health & Safety" in as an excuse and leave it at that. They need to back it up with a proper risk assessment. Then the ways of minimising those risks can be addressed. Say put a sign up when you're welding/grinding, etc. I have had a browse of the RoSPA website http://www.hassandlass.org.uk/query/reports.htm to try and get some facts about the safety of working on a car (say) compared to gardening, which I guess would be the alternative if there wasn't a car there. Unfortunately, they don't make it that easy But it's there if you need it. Also, make sure your neighbours are on board. Their support could go a long way, if you have to appeal a notice. It might be that they do want it hidden away. If so, pro-actively engage with the council about what kind of fence you can put up. Basically. Keep in touch, correspond in writing (it's slower than e-mail and phone and everything's on record) and address only a couple of points at a time). Sooner or later they'll run out of time/money/resource to keep pestering you, and they'll struggle to take any enforcement action against you if you are willing to engage and (to a limited extent ) co-operate..... FredTransit Posted June 3, 2009 Report Posted June 3, 2009 I don't think talking to them at all is a good idea, or wrting. One of our nieghbours (I know who) tried to complain, the council (we are not in a council house) tried to even go as far as saying we were contraveining planning laws. They gave us till the 21st of the month to reply, or go to court. Whilst we were wondering how to respond, a latter came to our address, with the nieghbours name on it (that's how I know who it was). It said that, as we had not responded, there was nothing they could do until they did, not even take it any further. That was December. The year before last. Never heard anything further.

andy a Posted June 4, 2009 Report Posted June 4, 2009 Under regs brought in last year residential addresses whether privately owned or local authority/housing association are restricted on how many vehicles they can have, a local Jag restorer ignored the council when they told him to remove a load of 30s-60's Jags he had stored at the rear of his property and ended up with them arriving with a 20 yard roll on skip, a hiab lorry and the police, the whole lot was moved for him. I know that's not the case here but I wouldn't ignore the situation, if they have the right to remove and you ignore them then they will end up doing it and could bill you for their trouble...

The owner went on holiday, when he came back the council had used some of their new powers(what ever they may be) to have it removed and crushed. I cant remember what the excuse was now though.

It's always down to money. It's not normally a case of money with council's, they have in house legal teams and the council tax payers end up footng the bill, it just depends on whether they are having a purge or are getting consistant complaints, their filing tends to be hit and miss so information will no doubt get misplaced from department to department, which I'm guessing is the way forward, kick off at them from several different angles and watch them lose the paperwork internally

Me old lady went out to see who the F he was, n he said there was tooo many cars on the drive (there are 4 to be fair) and that we had to move 2. The person who tried to grass me up however has for the last 12 months been signing on as unemployed, working 4 days a week in a factory, buying and selling cars from the front of their house and buying stuff at auction and selling it on ebay quite blatently, while the taxpayer is paying their council tax, and the interest on their mortgage, tell me how that works...

Did you move anything? TBH I wouldn't have. @ andy a, there's only one thing to say to that, people who live in glass houses shouldn't throw stones....
