Doc Posted November 16, 2009 Report Posted November 16, 2009 In one of the side streets near my work in edinburgh theres a mint and i mean mint 1.6 lazer on a D plate , it was being driven by a student who parked it up two months ago untaxed so now its clamped by the dvla for tax evasion ive left several messages on the car to buy it but he has never been back to take any tickets , my notes or docs left stuck to the screen . i was wondering can you legally take the abandoned car on ? I read somewhere that you could but i dont know how. any ideas ?
caprinerd Posted November 16, 2009 Report Posted November 16, 2009 have a chat to the trafic police they should be able to fill you in on the details of taking on an abandoned car
pnwrs2000 Posted November 17, 2009 Report Posted November 17, 2009 Just walk off with it Im sure if you did, you'd soon have someone knocking at your door - probably brandishing some furry hand cuffs
escortmad79 Posted November 17, 2009 Report Posted November 17, 2009 Grey area, I asked similar about a car on RR click here
Spanner_monkey Posted November 17, 2009 Report Posted November 17, 2009 I think I read somewere that you have to apply for a new log book and include a cover note explaining what the situation is. From there I believe the DVLA will contact the registered keeper of the vehicle and if they fail to respond then you will be issued with a new log book for that vehicle. Although I also believe that once the log book has been ishued in your name you would only be the registered keeper and technicaly not the owner. Hope that helps
Takeshi Posted November 17, 2009 Report Posted November 17, 2009 you would only be the registered keeper But therefore responsible for the car tax wise, where its parked etc
caprinerd Posted November 17, 2009 Report Posted November 17, 2009 a logbook doesnt mean you are the legal owner
Spanner_monkey Posted November 17, 2009 Report Posted November 17, 2009 exactly. but if when the DVLA contact the current registered keeper they may hand over ownership of the car.
escortmad79 Posted November 18, 2009 Report Posted November 18, 2009 Doc, do you know what college/uni the student attends?
yorkester Posted November 19, 2009 Report Posted November 19, 2009 Doc, if you go through all the channels, DVLA, Police, Council etc that are listed above and make all reasonable enquiries to find the owner then if the old reg keeper fails to reply to DVLA requests they may issue you with a new log book in your name. You will however only be the reg keeper and so responsible for all taxes and fines etc What you wont be is the legal owner and if they ever come forward you could have a costly legal bill trying to keep it in the civil courts
