lets get this straight hand guns are banned in this country you need a F.A.C [fire arms certificate] if you get caught with either a pistol or rifle that's not registered keeping in mind hand guns are banned you WILL GET A MIN 7 YEAR SENTANCE so i don't see why this bloke got away with it but then its the one rule saga again he had a unregistered gun so should have been banged up like me or anyone else would and lets not start but hes a soldier

It's not that straight forward. As I recall, he was sent back early and his gear was packed up in its entirety and shipped home by somebody else. The appeal centred on the fact that he didn't bring the weapon into the country. It was amongst his kit in theatre and was boxed up with the rest of that kit on his behalf and sent back to him by others (as he had left theatre early). He was in possession of the weapon, of that there is no doubt, nothing to do but plead guilty to that, especially with the courts hinting at leaning towards a 5 year custodial sentence in a civilian prison if he pled not guilty. But the circumstances behind how he came to be in possession and whether he knew he was in possession (i.e. having boxes still in his garage / up at the squadron that he had not unpacked yet), I imagine that those are the grounds of appeal. There are also medical claims that he suffers memory issues and didn't recall he had the weapon. Whether they're true or not is anyone's guess.

 

A trained special forces operative being caught with a weapon and ammunition in a cupboard in his house is also a very different kettle of fish to some back street hoody being caught with a Glock in one pocket and a bag of heroin in the other. Sentencing should be approached accordingly.
