If you operate heavy machinery or work in a cold enviroment then the rules are slightly differant , YOU GET MORE BREAKS . Also , you have a duty of care over yourself , if you work too much and dont have a break then have an accident , ya gaffer can say it was your fault for not having a brew break !! Ckeeky fekkers have done it in the past and have got away with it too

I'm H+S rep at work , just quote the Working Time Directive + Health and safety at Work act 1974 regarding "break times away from work" . Its all in there , he'll know it too . Also mention that you know someone from the H+S executive (well someone who works there) OR join a union (Unite,GMBU) and get all the free help you need Duty of Care for a SMOKE break wont cut it though , been tried before just give up the ciggies .
