Mr Sam Posted August 3, 2007 Report Posted August 3, 2007 while on holiday i was in an incredibly minor car accident heres my half of the story.... heavy traffic im at reasonable distance from the car infront travelling at the same speed theres 4 of us in the car (ill add now its my nans car and yes i was insured on it) suddenly the car infront is stationary, i slam on the brakes wheels lock up and go into the rear of a BMW. well to begin with i didnt even think he was going to get out it was a tiny bump no airbags went off popped a bit of trim off his rear bumper and scuffed the paint on nans micra i immediatly ask if he is okay, he was all cool with it said he was had a quick look and we agreed to park in the nearest car park to exchange details both exchange details he was a really pleasant local was even appologising himself and wished us a good holiday what was left of it, thought nothing of it after that... a week later i recive an insurance letter telling me to pas it on to my insurers (they spelt my name wrong) and today ive recieved a solicitors letter stating the chap has recived whiplash to my neglegant driving stating that 1failed to drive vehicle in a safe manner 2. failed to keep any or any proper look out (whats that meant to mean ) 3. failed to see my clients vehicle in tim e or at all 4. drove to fast for circumstances 5. failed to see my clients stationary vehcile 6. failed to slow down,stop, swerve or steer otherwise manouver in a safe manner or at all 7. failed to apply your brakes at all (how the feck do the wheels lock up and skid without applying brakes then ) 8. failed to avoid colliding with my clients vehicle (so im expected to swever into oncoming traffic or mount the pavement where theres a cyclist ) 9. exposed my client to a foreseable risk of injury im quite tempted to send it back to the sollicitors telling them to spell my name right for a starter what on earth do i do apart from pass it on to my insurers as stated???

It's a letter that's designed to make you feel shit for bumping into a bmw driving tinker lol. If he was suffering from whiplash I would have thought there'd be more damage to his car than just a scuff. If you've got his address, stake his house out and take pictures of him going jogging. Juby is a guy to ask (the guy I was at the CF show with) as he's in the business.
flyingbanana Posted August 3, 2007 Report Posted August 3, 2007 will say its your fault has you drove into him.....i had the same type of thing happen to me years ago...i was pulling out or a junction and it was clear then next min see the car coming towards me and he was speeding left a 29ft skid mark...but still my fault has pulling out...but he was ok but also said he had whiplash...which i knew he didnt has i knew him through some one else and he was building a shed 2 days after the accident....he got £7g pay out in total........do you have legal protection on your insurance?...has wessie says you have 3 people to give statements if needed......ive got a m8 who had problems after a accident...took 2 years to sort it out!!!!!

I really don't understand this mentality I've had people run into me on many occasions (sometimes I thought I ut have been driving an invisible van ) All I've ever done is swap details and pass it onto the ins co. Accidents happen, that's a fact. Don't stress too much about it mate. Do you have legal costs protectionon your policy? If so, get in contact with them ASAP and let ten know the score. If you havent got it....why not?

S2 Dee Posted August 3, 2007 Report Posted August 3, 2007 Sam, Bad luck there, don't worry too much this is a fairly standard letter. I would pass it to your insurance company, along with a letter explaining the curcumstances and exactly what happened the damage to both vehicles, pictures of the damage to your nans car too. There would be a lot more damage to the cars if he had suffered real whiplash. Pass the letter, see what happens, his BS will rise to the surface. Insurance companies are quiet good at sorting out exagerated claims these days.

tim Posted August 3, 2007 Report Posted August 3, 2007 the letter is propery from a blue light chaser,pass it on to your insurance,that why you have it dont know how it stands if they no witness reports but as you were behind then its would be down as ur fault i would think
Mr Sam Posted August 3, 2007 Author Report Posted August 3, 2007 i totally understand its my fault but its the claims they come out with like i didnt see his car i didnt brake and why couldnt i swerve im not to sure about what insurance on my side is like its my nans car and she added me to the policy for the holiday as in all fairness she is an awfull driver the really ironic thing is in the morning i visited a motor museam and payed close attention to this,,,,
