capriv8 Posted December 17, 2007 Report Posted December 17, 2007 and in a mk4 escort! chased him a while then called the plod - he handed himself in but where do i stand on insurane as he wasn't insured. do my insurance company have anyone to claim off?
Jimbob-Squarepants © Posted December 17, 2007 Report Posted December 17, 2007 'fraid not mate Unless your fully comp, but that only means your car will be repaired, or you will be paid out... BUT & there always is a but... you will then have a claim against you. This sort of thing happened to my dad on a regular basis (unlucky car), one time he was almost killed, and everyone drove off, he even went to the law with number plates etc. and apparently none of the motors existed. It pisses me off no end, us normal people have to pay for these w***ers who can't be bothered to insure their motors and 9 out of 10 times they don't have a license either. What happens, us (the mugs) that have to be legal by law, because it is the law apparently get f****d over by insurance companies and the government. The best you can hope for is taking him to court to claim aginst him. Get estimates for your motor and present them at court. But, he drove off when he hit you, so he can easily go missing from the courts without paying anything back. Makes me f****** sick!
sab6024 Posted December 17, 2007 Report Posted December 17, 2007 I had a guy drive into the front of my Sierra a few years ago and he wasn't insured, taxed ot MOT'd I was insured TPFT and managed to get a claim for the damage and my loss of earnings. I got one of these no win no fee companies to get involved and they went through the Motor Insurance Bureau for my claim (that's what we pay for in our ever increasing Insurance premiums). It took ages but I got the money in the end and they paid for the repair of my car Unfortunatly I wasn't able to have a courtesy car though. I was involved in a hit and run in the same car but luckily did no damage. The car was carrying wrong plates. Lucikly my tow bar went through the front end of his car leaving a nasty mess on the road so he wasn't hard to find by the Police. Some muppet in a S2 Turbo showing off to his mates Good luck with sorting the car
Admin Vista Posted December 17, 2007 Admin Report Posted December 17, 2007 Yes you can claim, as Sab said you need to go through the Motor Insurers Bureau. There are details and downloadable PDF's at this link http://www.direct.gov.uk/en/Motoring/Ow ... /DG_067639
capriv8 Posted December 17, 2007 Author Report Posted December 17, 2007 not happy with (quote me happy) so far i have managed to get them to do an estimate , but that takes 5 days ATM due to workload. No curtesy car (luckily i still have an E30 mot'd n taxed for now). if i claim through my insurance then it goes as a fault claim unless i take a court action against the third party - I reminded them that i took the legal cover so that was fine. However they think that i am not covered for this scenario! I say some rude words and got passed to the manager - far more helpfull but still same stance. So all i got for chrismass was a fooked pug, assole mr rodgers in london and a bill for £1800 so far that i can't claim i think i'm gonna find a bottle and crawl in - see you in the new year!
capriv8 Posted December 18, 2007 Author Report Posted December 18, 2007 oh and on top of that some bastard in Oz has started taking money from my account. Warning to all be really carefull at Petrol Stations and with your internet purchases! 3 people i know are being fleeced so cover your hand when entering the pin! £800 so far! They say bad luck comes in 3's i'm wearing a ball guard just in case!
sab6024 Posted December 18, 2007 Report Posted December 18, 2007 God you're not having much luck are you I didn't go through my insurance company when I made my claim. I went through a company called Crash Care (I think) and they put me onto a specialist Solicitor. I didn't lose my no claims either. I don't understand why you can't claim if the other guy has admitted liability and the police have it on record If you're insured and he hit you then it's not right you should suffer the costs. I hope you get it sorted and have you got the bank involved with your card fraud???
Mrs O/H/C Posted December 18, 2007 Report Posted December 18, 2007 OMG YOU ARE HAVING A BAD BAD DAY !! HOPE ALL GOES WELL AND BETTER LUCK IN 2008 !!
