Messenjah Posted July 31, 2008 Report Posted July 31, 2008 i was a passenge rin the works van today and the driver was not paying attention and had a crash into the guy infront my knees smashed into the dashboars because the van has no leg room and i have long legs and my knees are killing me and my neck is actually a bit stiff i am seriously tempted to try and claim compensation off the company but i dont want to do it if its going to come back on the driver because he is a good guy if i try to persue a claim will it come back on the driver personally ?
Admin Vista Posted July 31, 2008 Admin Report Posted July 31, 2008 No, the company probably isn't very pleased with him for crashing the van anyway but any claim you make will be off the companies insurers. P.S. need a Personal injury lawyer to look at your case? edit: You claiming compensation would not come back on the driver, the money (if any) would come from your companies insurers. But if the driver is at fault for the accident (which it sounds like he is) then this will likely come back on him whether you claim or not.
Trevmk3 Posted July 31, 2008 Report Posted July 31, 2008 not sure if it would come back on the driver, it would if the accident was classed as him not paying attention, but if it is classed as a vehicle on vehicle accident then i feel sure it wouldnt. if you are hurt then i would try and get some compo from it, espicially if it is affecting you. (this is only my thought on what it would be classed as, and i am not qualified in any way as to know the actual ins and outs, so to speak )
prefectopop Posted July 31, 2008 Report Posted July 31, 2008 As a company owner, I know that any claim made would come out of the company's insurance. We are probably talking about 2 different insurance policies here though. At a guess, I would think the car accident would be claimed through the company's vehicle insurance. As an employee you may find the company will have to claim through their employers liability insurance. The best thing to do is speak to your boss and explain the situation. It's not your fault the guy crashed and whether he's a good bloke or not doesn't make any difference. I know that if I was in a situation like this I would want to make sure that all my employees are OK. However, if you want to claim just cos you want some money, I don't think that's right and your company may not look favourably on you. So think carefully about your options, and do it based on your own decisions, not what others tell you to do.
Savvi Posted July 31, 2008 Report Posted July 31, 2008 I would advise you to go to the hospital to get checked out. I had an accident in 1992 in a works van got took to hospital as my neck hurt, i didn't make a claim although was asked if i wanted to and deeply regret it now. I am still in pain 70% of the time and have to go for chrio every month, i got sent to the Harley street to the Rac's chief medical examiner (was a Rac Patrol at the time) as it was claimed i was off work 2 or 3 times a year when the pain got to bad to get out of working. Not sure what was in the report but they paid for my treatment and let me have time off afterwards !!! Long and short of it, as i have got older the pain has got worse but because i didnt start a claim within 3 years i can do nothing about it, cannot get any financial help and have to work whether i like it or not !!! Don't think about the driver the company etc make sure you have a claim started and get checked out ASAP you may well regret it in the future.
over_head_cam Posted July 31, 2008 Report Posted July 31, 2008 As above really mate. You need to look out for yourself for the future. It's business, and you shouldn't feel guilty for making sure YOU are Ok. I might sound cynical, but I'm sure your company won't be interested in how you are 5 or 10 years down the road. Deffo get yourself checked out. It may be nothing, but from experience I'd say you can't be too careful
X-pack-Glyn Posted July 31, 2008 Report Posted July 31, 2008 I would advise you not to claim... its stuff like this that puts EVERYONES premiums up... 20 years ago if you bashed yaself at work..tough luck... but at least you could insure things. i believe this kinda thing came over from america? oh, i dont know how much you value the job but if your there for the long haul dont claim, people that make claims dont last very long in companies, i know someone that has had problems getting future employment due to making claims also. if it were me id put it down to experience and take more care in the future.
