lee337 Posted December 14, 2008 Report Posted December 14, 2008 i sold a sierra to a bloke i work with middle of last year, he asked me not to send off the log book in his name as he only needed the car for a week and was going to sell it on again. one week later he sold the car but didnt send the log book off and the new owner hasnt sent it off, so its still in my name and now ive got the dvla threatening to take me to court for not paying the tax. do i pay the £80 fine and learn from my mistake or should i go round to the new owners house and tell him £80 or i take the car back, or should i just go round and take the car as iam the registered keeper and i still have the spare set of keys?
Univex Posted December 14, 2008 Report Posted December 14, 2008 Did you give him a receipt? If you did, even though you are the registered keeper it doesn't make you the owner.
Savvi Posted December 14, 2008 Report Posted December 14, 2008 Always make out a receipt, although you are legally bound to fill in the V5 now when you sell a car ......................... they can get "lost" in the post, in which case if you send a sales receipt with the new owners name and number they will leave you alone and chase them. I've had it a few times when buying and selling 2nd cars.

60ftman Posted December 14, 2008 Report Posted December 14, 2008 Write back to the DVLA, told them when you sold the car, who to, and his address. I had this problem a couple of years ago when I traded in one of my cars at a dealer. The dealer sold it on, and the 'new owner' not only didn't tax it, but parked it everywhere he could. on double yellows, in disabled bays etc etc. I had a load of correspondence with the DVLA and two councils, but it was only after I suggested that they remove the car and crush it the next time it was ticketed that they started to take me seriously. Cost about £4 in stamps, but I got the fine dropped in the end.
bortaf Posted December 14, 2008 Report Posted December 14, 2008 Had this before as well, it's your leagal obligation to fill in the V5 AND if you havn't had a letter confirming your no longer the owner within 30 days it's also your leagal obligation to contact them and see why. scrapped 3 cars this year and coped £60 fines on all of em cos the yard never sent the V5s off and i got done for not sorning them when the sorn they were on ran out. Nowt you can do cos you did it wronge i'm affraid, allways follow the rules/law and your mate aint a mate cos he fecked you over by not filling in the V5 when he sold it, i'd go visit him for some money to cover the fine, basicly he asked you to break the law and you did went to court the first time and ended up owing £120, just paid the other 2 rather than get coped for more

Conor Posted December 14, 2008 Report Posted December 14, 2008 Pay the fine. It is the sellers legal responsibility to notify DVLA. THE REGISTERED KEEPER is the one who gets sent the fine for no tax from DVLA, not the owner, and I don't know anyone who has successfully appealed it.

You are right to degree CONOR , but i had this with a 7 series i sold i 06 to a Trader . He hadn"t registered it etc , got the fine through the post etc . Wrote to DVLA and told them in the strongest terms that i did not own the car , had sent the V5 off to them and basically if that had been lost in the post or that there records where not up to date that was there fault and not mine . Never heard a thing again , and no i didn"t pay the fine .
danny69 Posted December 15, 2008 Report Posted December 15, 2008 Phone the DVLA and tell them you sent it off the slip but maybe it got lost and that it is no longer your car, and then give them the address of the new owner. I bet this happens alot.
