Whats the difference in manslaughter and murdering someone ?

 

Why im asking is the case thats going on with Jo Yeates .

 

Vincent Tabak admits manslaughter but not murdering here wtf surely strangling someone to death is murder? :think:

if you have the intent to kill it's murder

if you don't intend to kill but do it's manslaughter

 

 

its a bit like some one saying they will send you a tee shirt, an don't you say you will kill them,and do ....thats murder :wink:

yeah but will get 5 yrs for manslaughter not 15 to 20 thats why admits to it

Murder is premeditated and manslaughter is generally accepted as having been done on the spur of the moment, i.e. the perpetrator had no intent to kill.

 

Just to complicate it further, manslaughter is further subdivided into voluntary and involuntary.

 

Voluntary is where some one did intend to kill but there are mitigating circumstances which reduce the amount of blame (provocation for instance in the case of an abused wife killing her husband). Or where the perpetrator intended to cause serious harm but not death.

 

Involuntary manslaughter is the unlawful killing of another person that wasn't premeditated.

 

Think you've got it now? Well no because involuntary manslaughter is further broken down into constructive and criminally negligent. Which I shan't go into any further

 

 

Oh and if that isn't confusing enough, across the pond they have murder in the first degree, murder in the second degree, and a whole bunch of other names for different types of manslaughter.

my mates son had a meat cleaver smashed into his skull + the man who did it got charged with abh not attempted murder! how the fook can you say i chopped into his head but was not intending to kill him? :?

+ the joke of it all he got off with it due to lack of evidence !! :evil: true story.
