t33stat Posted November 13, 2009 Report Posted November 13, 2009 I had an accident today luclky wasnt in my capri but still a bummer! Just wondering if you guys can help me decide who's to blame. My initial reaction was that it was my fault, as i went into the back of him ... But i have heard things that make me feel unsure Basicly we were sat at a t junction, and both turned left, just after the turngin there is a fairly steep hill and a line of cars, there is only enogh room for one car to be on the hill at any one time. she pulled away, went to go up the hill, and then breaked sharply because there was a car coming down the hill (there is a spot to stop on the hill) because she moved and made intent to climb the hill i moved off, and then when she stoped it was to late for me to stop. So the argument is ... 1) i went into the back of her ... my fault. 2) i was to close to her to stop ... my fault 3) she stoped unduely and sharply ... posssibly her fault 4) she was not following the highway code (uphill has right of way) ... her fault 5) stoping when you have the right of way is not something any driver would expect and thus coulnt prepair for. So as you can see, its a hard one for me to call Time to drown the sorrows! Thanks Ryan
emu Posted November 13, 2009 Report Posted November 13, 2009 I would think that as you didnt give yourself adequate stopping distance then it is your fault im afraid. Unless she rolled back into you of course Least your ok though, thats the main thing
Copey Posted November 13, 2009 Report Posted November 13, 2009 as above mate, its technically your fault, even if she was being a daft bint
2.8i Cossie Posted November 14, 2009 Report Posted November 14, 2009 I would think that as you didnt give yourself adequate stopping distance then it is your fault im afraid. Unless she rolled back into you of course Least your ok though, thats the main thing hate to jump on the bandwagon but yeah this is the way it goes. I had a policeman out at a friends accident who went into the back of someone who had no rear working lights but because 'we were too close to safely stop' it was our fault even though all of us and a witness said the rear lights didnt work.
Admin Mk2Jo Posted November 16, 2009 Admin Report Posted November 16, 2009 I'm afraid it's your fault
vibrating_Cake Posted November 16, 2009 Report Posted November 16, 2009 bad luck dude, just be happy it wasnt in the capper. always your fault, it could have been a kid walking out between cars, she stopped, you went into the back of her.... if you moved her car she would have hit the kid....... its all the same at the end of the day insurance will go 100% your fault
caprinerd Posted November 16, 2009 Report Posted November 16, 2009 as all have said mate sorry, you go into the back of someone no matter what the reason law states your at fault as there should of been a good distance between you and the car in front. sorry mate
X-pack-Glyn Posted November 16, 2009 Report Posted November 16, 2009 her fault... what was she doing behind the wheel of a motor car?? Her husband/boyfriend should have been driving. critics say that if half the women were taken off the road the accident rate would drop 72%.
Yeomans22 Posted November 16, 2009 Report Posted November 16, 2009 sorry to say its more than liklt your fault, although my friend failed his driving test a few weeks ago because he had to do an emergency stop, when driving not when he was told and never put his hazzard lights on to show he had done an emergency stop. if thats correct she should have put her hazard lights on when she stopped, but i dont think that will help.
Mr2Caps Posted November 17, 2009 Report Posted November 17, 2009 I seem to recall reading somewhere that this was a topic up for debate amongst those in the insurance industry, because as it stands at the moment the person who runs into the back of the other car is always to blame. Think this has been brought about by the number of scammers deliberately making people crash into the back of them by overtaking and then braking suddenly........don't think this is going to help you though, sorry.
Ste-V Posted November 18, 2009 Report Posted November 18, 2009 Least you wasn't in the capper mate Sorry to hear about the accident though

You don't need to put your hazards on when you do an emergency stop Unless you are causing a hazard yourself
Ste-V Posted November 18, 2009 Report Posted November 18, 2009 Yeah, I passed my test 2 years ago, and I don't seem to remember having to put my hazards on
