As for treating it as theft I got told that my problems couldnt be treated as theft as the person involved intended to give it back. So did you but no effort was made to remove it. As said previous if some shits on your doorstep and you clean it up can they come back a year later and say you stole their turd!! Go see a solicitor ASAP. Can't see the police treating it as a serious matter if they were you'd have been lifted and the car would have been taken back from the fella you sold it too after all DVLA have his address and he could have been charged with handleing stolen goods etc etc. Plus you could contest the fact it was worth £500, whats the glasses guide price on the busted car £50 in scrap??
Admin Vista Posted January 7, 2010 Admin Report Posted January 7, 2010 Go and see a solicitor and get some advice. Even if they arrest you, the CPS has to decide whether there is sufficient evidence to pursue the case. I assume you would plead not guilty?
Daggle Posted January 7, 2010 Report Posted January 7, 2010 Kind of stayed out of this, as there is always 2 sides to a story, but just to throw my two-penneth in, then I will leave this little nugget 1 Basic definition of theft (1) A person is guilty of theft if he dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it; and thief and steal shall be construed accordingly. Basically from what you have been saying then I can't see how it can be theft as there is no dishonesty involved in your appropriation of the property (car), unless I am very much mistaken, seems like a civil matter all the way to me, but then again what do I know I think you need legal advise my friend.

The police don't normally ring you up and disscuss these things with you over the phone, if an alligation of theft has been placed, they are dutifully bound to come round to you face to face and either arrest you or take your statment. I would guess from what you have said that perhaps they might have had someone ring you and pretend to be the police. And if that is the case, Woe happy days, they can get shafted so harshly with frosty sausages for that...I mean prison time.. Thought I'd high light that bit as I so want it to be true Shame it's not though

Could well be, however I wanted to point out what might have been the truth, don't want the OP being given duff advice from someone who by the sounds of things can't comment on something that he don't have the knowledge about.
Daggle Posted January 7, 2010 Report Posted January 7, 2010 Nope, don't know more than you, and I've see this satnav you are taking about, the fire brigade use them too, I know this when they drove up the dirt lane foot path at the side of my house and got stuck there for 9 hours. Tell me about it, that will be the one they use that they think is okay to drive the wrong way down a motorway slip road to get to a car on fire with oncoming cars?? but this is getting away from the original post, back on track, get some advise from a pro, even if it costs you a few quid.

Didn't even think about that statement I have been out on the motorways for too long , don't see many of them about apart from in the truck parks
retrorigg Posted January 8, 2010 Author Report Posted January 8, 2010 it was defo a copper that rang me coz 1st time she rang on a withheld number, so i didnt answer it, she left a voicemail with the correct number for the police station with an extension number, then rang me again ten mins later, surely saying if i dont give them £500 they,ll take it further, isnt that a kinda blackmail or would it be classed as a kinda outa court settlement thingy i really wanna be arrested for this as daft as it sounds coz surely to god this cant go to court , althought the only thing thats worrying me is that if i do get charged with theft i could loose my taxi licence which is my livelyhood, im gonna try get to see a soliciter 2mrw on one of those free advice thingys that they offer the only diffrence between ur case and mine is they actually have made a complaint againsy me and i presume say ive stolen there car, tbh the police womans tone today almost kinda told me that she thought it was ridiculas and got the impression that they had to arrest me for theft but could tell in her voice she didnt sound confident in wot she was saying as if to say ok they,d arrest me but whether id be charged with theft would be a diff story, she did say her seargent had got her to ring me as it was the seargent that the complaint had been made to, im guessing he,s got her to ring me to try get me to try resolve it with the car owner as in it wasnt worth him bothering with such a petty thing, the police doris did seem really keen on me sorting it in civil matter way rather than me been arrested im just hoping i can get to see a soliciter 2mrw wish me luck

Retrorigg might just end up replacing one yard orniment with another, they probably won't accept it.

But I would tell the other folk that you intend to fully deny the charges and when you get let off you will sue for loss of earnings full cost etc etc !!! Although if they are sitting on benefits you will only get offered the queens shilling!
retrorigg Posted January 8, 2010 Author Report Posted January 8, 2010 spoke to a soliciter this morning, basically he didnt really say wot to do, he kinda agreed with wot i said in wot had happened but said if i want it off my hands the easy way would be to give them the £500 or offer them less for example £100/150 to allow for some storage , or if im arrested to call for him (hes a legal aid duty soliciter) and tell the police my side of the story and then it,ll be put to the cps and it,ll go from there whether its good enough case to go to court, im still adamant im not givin them £500 and im pretty adamant i dont want to give them any money what so ever, i get the jist that if i hadnt told them from the beginin that i would be charging them a storage fee then they are ok to believe that i was storing it as a friend thing for free, i really dont know what to do, im tempted to text the mother and say im stickin to the £80 offer that i got for the car but im expecting she wont accept that so im guessing the next step will be ill be arrested ,

Personally, if it was me and the events were as you say they are it would stick in my throat far too much to give them £500 for an old nail that was worth tuppence happeny so I'd probably fight it in court.
