Rick Posted January 24, 2009 Report Posted January 24, 2009 right as you know i had a bump int escort i need to deal with it best i can so i dont end up paying £5000 next year it was pretty minor as far as his damage was concerned and im doing all my own repairs. obviously im not claiming at all but i guess he is, so i need to give a response thats going to leave him paying for his damage and me paying for mine, if you get me/ answers on a postcard do i say that he just slammed on his brakes to make a last minute turning (which i think he did anyway) and that older cars cannot stop as quickly. i wasnt breaking any speed limits anyway so that doesnt come into it.
Takeshi Posted January 24, 2009 Report Posted January 24, 2009 I'm not sure really, it'll probably be a 50/50 agreement at the least, but when you go into the back of someone they almost always blame you, unless you have hard proof that he did brake at the last minuite. Example: My mum was doing a right turn at a junction, the oncoming car indicated to go left, mum pulls out to go but the young girl changes her mind and ploughed straight into my mum. Her and her words against each other - mum lost 4 years no claims bonus. Because majority of the time, it is people who pull out in front the other that cause the accident. I went into the back of someone just over a year ago in my Rover. He decided to turn right all the sudden, and no way could I stop doing 60 - 70. He accepted it was his fault, and went on his way. But no point claiming since they'd blame me, and probably write the car off, just not worth the hassle. Best of the luck though
flyingbanana Posted January 24, 2009 Report Posted January 24, 2009 if you went in the back of them.....you have no chance winning.......take it like a man and just take the blame..........ive only ever had one accident caused by me has i was pulling out of a junction.....even tho he was speeding and left a 29ft skid mark in a 30mph zone.......my insurance never went up....in fact it went down
tim Posted January 24, 2009 Report Posted January 24, 2009 do i say that he just slammed on his brakes to make a last minute turning (which i think he did anyway) and that older cars cannot stop as quickly. i wasnt breaking any speed limits anyway so that doesnt come into it. they will just say u was travelin to close to the car in front to stop safely
2.8i Cossie Posted January 24, 2009 Report Posted January 24, 2009 do i say that he just slammed on his brakes to make a last minute turning (which i think he did anyway) and that older cars cannot stop as quickly. i wasnt breaking any speed limits anyway so that doesnt come into it. they will just say u was travelin to close to the car in front to stop safely exactly. Insurance comapny will say that you were driving too close and did not have enough space to stop regardless of the speed you were doing. Plus in an older car with less effective brakes you should allow additional space
Rick Posted January 24, 2009 Author Report Posted January 24, 2009 yeah thats what i thought it was my fault i just hope i dont get shafted come renewal time
antz Posted January 24, 2009 Report Posted January 24, 2009 pay for his repair out of your own pcoket? that way you dont claim on insurance and neither does he and your both happy.
stevepeanut Posted January 24, 2009 Report Posted January 24, 2009 pay for his repair out of your own pcoket? that way you dont claim on insurance and neither does he and your both happy. yeah I agree with that, if I hit someone and I could sort paying for their damage and it was something like less than £500, I would pay it, to avoid the insurance hassle. A truck pulled out on me once, and I crashed my brothers rover into it, guy who owned the truck company, paid me cash to get the repair done
Admin Vista Posted January 24, 2009 Admin Report Posted January 24, 2009 Rick, he's going to claim and if you contest it he will almost certainly win, in fact there's every chance that you will not get the right to contest it as your insurer will pay out knowing that they would lose if they contested it. You will also likely find that he will want his car repaired at the best insurance approved garage which will likely be far more expensive than the one you would choose if you were to offer to fund his repairs. Plus, even if no claim is made on your policy if your insurers are already aware of the incident it'll still count as a fault collision against you whether a claim is made or not. In light of the above if you're fully comp then claim for your own damage too, that's what you have paid £1000's of ££££££ over the years to protect yourself against after all.
jamie k Posted January 24, 2009 Report Posted January 24, 2009 on the other hand a guy over took me pulled infront and breaked i hit him square up the arse but he got the blame. but before you say this think about it, if you were driving and someone hit the back of you then claimed you how would you feel .? just admit it and get it over with . your premium might not change too much , my mate got banned for a year and when he reinsured his escort cossie with lots of mods it was cheaper than before his ban
Rick Posted January 24, 2009 Author Report Posted January 24, 2009 il just face the music, il certainly be paying more attention next time
