mr zefect Posted May 28, 2010 Report Posted May 28, 2010 A few weeks ago i was a silly boy and got caught by one of them white vans on the a3 going 88 in a 70 in my other halfs st focus and got letter wanting to no who was driving i no i should hold my hands up but ive only just got rid of my 3 points i got 4 years ago does anyone no any way i can get away with it.
garyv6100e Posted May 28, 2010 Report Posted May 28, 2010 Have they sent you a copy of the photo because if it was a forward facing camera it will quite clearly show you behind the wheel so you have to be carefull if you other half was willing to take the fall for you otherwise you will be in a whole lot more trouble than just a speeding ticket , if it was a rear facing camera it only takes a picture of the rear of the car then they can not prove it was you driving but your other half will still have to take the penalty , i know this is not much help but i know what its like just as my licence is about to get cleaned up i get done by one of these bloody vans
mr zefect Posted May 28, 2010 Author Report Posted May 28, 2010 Yes mate it was foward facing i dont no how they got me i slowed right down way before it must have some range on them the gutting thing is i go up the a3 every day on the way to work and i havent seen it for months and i havent seen it since i supose they make so much money in one day they dont need to be there that much wa**ers.
kev16v Posted May 28, 2010 Report Posted May 28, 2010 tell em there's more than one driver of the car. an could they send u the pick of the the car so u can see for your self whos was driving at the time . if there not trying to pull ur pants down they will send u it no problem its worth a try they might drop it if the cant send u the pick
flyingbanana Posted May 29, 2010 Report Posted May 29, 2010 lucky you dont live in bedfordshire....they got cameras covering all ways now http://www.dailymail.co.uk/news/article ... sides.html except what you did and they might even offer you the chance to remove the points by going to a 1 day course ....but you don't get offered again if you are caught again within 4 years ..good luck
SebringRS Posted May 29, 2010 Report Posted May 29, 2010 My friend got a choice of take the points or go on a driving course?? Not sure how he got the choice, but if u take the course you dnt get any points on ya licence?? EDIT: Only just noticed it had been said above, i should read everything first
mr zefect Posted May 29, 2010 Author Report Posted May 29, 2010 Thanks for your help boys i have been told by a few people to ignore the letters and see what happends as they have done the same and got away with it.
caprinerd Posted May 29, 2010 Report Posted May 29, 2010 i got a tug a couple of weeks back, my own fault, copper was a nice guy and put me down as doing 90 instead of 105, i got 3 points and a £60 spot fine, could have been worse id just pay the fine and have done with it the only time i got offered to do the improvement course was when i rammed 2 step through scooters on purpose never got offered one for speeding
D-FENS Posted May 30, 2010 Report Posted May 30, 2010 My son got offered a driving course for a speeding ticket recently. The paperwork said it depends on the actual speed as to whether you are given the chance to go on a course or not .He was clocked doing 36 mph in a 30 mph zone and as this was within the allowed limit he has six months to apply for a course or get fined and get points.
Smudger105e Posted May 30, 2010 Report Posted May 30, 2010 Just did a course after being caught for 36 in a 30. Cost £67 for a 5 hour course, wasn't too bad. Went with Mrs Smudger (we got caught by different cameras within 3 weeks) and she got the giggles! The Instructor passing wind didn't help the giggle situation! If you get offered the course, they are different costs and different formats in different Counties. Mine was a 5 hour course in Nottinghamshire, and all classroom based. The one offered by West Sussex Safety Partnership (even though I got caught in East Sussex) was £105 and involved some practical work as well, so shop around if you are on the border of several Counties! And you don't get points if you do the course, but should you advise your insurance Company so that they can bump up your premiums?
Admin Vista Posted May 30, 2010 Admin Report Posted May 30, 2010 Thanks for your help boys i have been told by a few people to ignore the letters and see what happends as they have done the same and got away with it. Bad advice I'd say. Most probably just end up with a court summons and they always end up more expensive than a fixed penalty
Mrs O/H/C Posted May 30, 2010 Report Posted May 30, 2010 I would not ignore the letter, as Scott said you will be more than likely penalised harder
Fishtailparka Posted May 30, 2010 Report Posted May 30, 2010 If I was doing 88 in a 70 I would know there was a chance I was going to get caught and also know the consequences if I did get caught. Having not got away with it I would accept the fine and points, not go on to see how I could get away with that too. I don't really see the problem with 3 points on your lisence, they don't make any difference to anything do they. Any insurance I have had has ignored them. If you have a job that insists on having a clean lisence don't get caught in the first place. I definitely wouldn't ignore the letter, nor would i think I might get away with anything. Just pay up and move on.
andy a Posted May 30, 2010 Report Posted May 30, 2010 I got caught at 34 in a 30, fixed penalty, if I'd been at 33 then they would of had to let it go because of a 10% allowance, at 36 I could of done a course and not got the points, so the lesson is if your going to break the speed limit do at least 36 in a 30 and you wont get points
Mr2Caps Posted May 30, 2010 Report Posted May 30, 2010 A few years ago I got caught doing 34 in a 30, I received the notification just under two weeks later, just under two weeks after that I got notified that I had been caught again on the same bit of road doing 36.... I got offered the course, which was about 70 quid to get 3 points instead of 6 (3 for each) which I did, it was a classroom based course, with a computerised element to it, which showed I had better than average reaction times and awareness, which begs the question "who's the more risk the driver who is slightly over the limit but more aware, or the driver under the limit but texting, looking at the sat nav, changing a cd and picking his/her nose?" Just as well I'm not bitter about it...... I was advised when I completed the course that because I passed I didn't have to inform anyone, as I had been rehabilitated and was now a fit and proper member of society once again. It obviously worked too, because it was only a matter of months before I got caught again
andygfc Posted May 30, 2010 Report Posted May 30, 2010 If there are two drivers who aren legally entitled to drive the vehicle, and no photo showing who is driving, and you cannot recall who was driving at the time of the offence , you can only be fined. Worked for Neil and Christine Hamilton (and myself ) Ask for photo evidence
jambo77 Posted May 30, 2010 Report Posted May 30, 2010 thay only have six months to do you for speeding coz i got caught and a letter turned up on my door step 3 days before i moved awarding my 3 points for great driving i think ! so i ignored it and moved. two and a half years later i got balifs letters for un paid court costs of which i knew nothing about . it turns out that coz thay didnt do me for speeding within six months thay had taken me to court for failing to prove a driver but as i didnt know anything about it i went to court for a first time looked at the pic of me doing 42 in a 30 admited everything and got let off coz it was to late. it was a strange feeling telling the court yep thats me speeding and walking out scott free .

The fine was higher too.
bigdaz27 Posted May 30, 2010 Report Posted May 30, 2010 take it like a man is my advice if you value your licence dont speed its as easy as that
turbo-mike Posted May 30, 2010 Report Posted May 30, 2010 Look you are only pissed about getting a ticket not the actual offence of speeding whice you should. I too have a st focus and according to my sat nav at 80 on my speedo the sat tells me I am doing 72 so for you to get caught at 88, on your speedo you must have been doing nearly a ton, so come on take it like a man, I too speed and have the tickets to prove it, but I am the one that made the choice to speed so when I get caught I pay up as it was my choice to speed no one else's. mike
stevepeanut Posted May 30, 2010 Report Posted May 30, 2010 agree with mike and daz, take it, its only 3 points, trying to find a way out is bad karma, it'll come hit you worse if you lie and try and get a way out of it I've been caught a couple of times, now I watch my speeds carefully in 30 / 40 / 50 zones and stick to 75 max on the motorways
w p e Posted May 31, 2010 Report Posted May 31, 2010 hold your hands up but then insist on a copy of the calibration certificate for said camara on said day in the said van. see what they come back with. these camaras are ment to be calibrated every day before use but been told on good authority THEY DONT
jambo77 Posted May 31, 2010 Report Posted May 31, 2010 like your thinking W.P.E . to get off on a meer technicality would make me chuckle all the way out of the court house .
flord escort Posted June 1, 2010 Report Posted June 1, 2010 as has been said you have the right to ask for photographic evidance and ask for the calibration records if you recieve these and your face is not identifable send a letter stateing all the names and addresses of people who could have been driving that car leagly on that day( about 15 people )you will be taken to court but not for speeding it will be for failing to identify the driver you can prove you have given all reasonable asistance the case would be thrown out this has worked for me i might be able to find draft letters if you want to risk it ? but this is a lot of hassle and could back fire badly for three points on a clean licence it i would put my hands up yerrrrr right
