over_head_cam Posted October 9, 2006 Report Posted October 9, 2006 I work at a ford dealer's and the customer has to sign the job card where there is some text saying we only do the work they have agreed to have done and anything else we will tell them about!But we had a pikey in who signed with a x and when he came to collect his transit and got the bill he said he was not paying!! He said he could not read or write so could not read the text or sign for the work to be done! He got givin his keys as you cannot KEEP HIS VAN AS THAT IS THEFT!! the money owed has to be sorted out in court! There you go

If it's illegal to keep the next door kids ball when it comes into your garden breaking all your greenhouse windows, as is frequently seen in the papers, then it must be illegal for him to hold onto your cars. Get the police in on him.

1uk3m4n Posted October 10, 2006 Report Posted October 10, 2006 with the small claims court all you have to do is pay i think its £85 and then all you do is bring the bloke to the court and you him and the judge sit in a room and talk it out if you tellt he judge your side then he has to rule in favor of you IF YOU GO TO A SMALL CLAIMS COURT DO NOT BRING A LAWYER/SOLICITOR ALONG

Apparently they are perfectly within the law, and that it is the garages responsibility to seek compensation court. If this is true then you can just turn up, hook up and offski A garage has no right to hold onto a vehicle unless it is deemed that the garage has made a betterment to it, by your reports he has not you have a right to collect without payment. The fact that he is not releasing you car is in itself an illegal act. Go and collect the vehicle yourself if he will not release it do not enter into any arguement, call the Police and wait until they arrive. Best of luck Vince
d8vyr Posted October 14, 2006 Report Posted October 14, 2006 deffo call trading standards doc, it worked for us we only had to tell the garage we had phoned them and it was sorted out within 10 mins after they had messed us about for an hour and a half. trading standards advised us to write to the garage with what we wanted done and send it recorded delivery, giving him 14 days to reply. then if he didn`t they would deal with it from there...there is a common scots law stating that even giving someone bad advice is wrong and plus we know for a fact that they can`t hold the car you don`t owe money on even if you owe them money for another car . this info is only a couple of months old, can`t imagine its changed since then. if want any help i`m not that far away, and i will do what i can to help(legally) hope you get it sorted davy 07990805862
morcheen Posted October 14, 2006 Report Posted October 14, 2006 contact all the local papers and radio stations and classic car mags.what about getting some independant bodywork experts,from a franchise dealer maybe,to check the work,and as said before,get legal advise,and if you are within your rights to take the car back,get the police there when you do it.good luck.but first log your complaint with the police,so they have a record of the situation. good luck.if all else fails get a load of pikeys to recover it for you,who messes with them?

We should definatley name and shame these people, these scum depend on honest people like us for a living, so the more we can share info like this the better. Hope all goes well mate.

Unfortunately while certain national magazines dont take it on themselves only to promote upstanding garages and accepts anyone that pays the advertisment fee without regulating then unsuspecting owners wil be caught out as i have been . Monthly advert in CF and bingo all this trouble. It can only give cause for concern. Ive read on turbosport that others have had issues . Still as long as he pays for his advert that will be good enough for CF. I wonder if general opinion counts for much with the people that write about the scene and who should have our best interests at heart........ Doubt it !

One thing i would suggest though is utilising the medium that can make or break a business nowdays. Yep....the tinterweb. You should set up a site dedicated to the trouble that you have gone through. Go into as much detail as possible. Hell, it might even get media coverage eventually. Just look at the guy who wants to crush his Pug 307 because of the aggro he got from Peugeot. A damning website EXPLAINING, not BADMOUTHING or SLAGGING OFF his company will come as a tremendous blow. Face it, anyone googling his compay will find your website too. Overall the legal route is the best plan. But what about after you have a settlement? He carries on trading? No, no fooking way. He needs to be hit where it hurts. This thread will be a dent, but it could be made a lot worse for him. And the best bit is that if you, as i'm sure you will, stick to the facts, you won't actually be breaking any law. And you'll also stay firmly on the moral highground. Well.....thats my 2 cents! Chris

Shame your in that situation, i had a mate who gave his corrado to a firm to be turbo'd. 3 years later and about 5000 down the swany he still aint got it back!

I only owned the car a week and then sold it for £2000 and at a loss to the £3400 i paid mate ...... Sorry you feel i tucked you up . . . . . The car was none of my work all Retrosport. We were both mis informed when it came to that Anglia including the Various Classic ford articles extolling the cars and the garages virtues...... Ill be more careful next time thats for sure. I wouldnt sell a car that i thought was dangerous or crap just ask Cmpod . Dont care how much i lose financially . I really thought the car was ok and it wasnt till Dalek informed me of how much bodywork you are doing that i found out how rusty it was /is ..... Sorry Mac. By the way lads im over the whole Retrosport thing .. I have the car back , i lost a load of money and time and you can all make your own opinions on it all . im well rid of the whole drama !
