mexicotype49 Posted December 8, 2013 Report Posted December 8, 2013 Driving through northampton in traffic trying to get on the M1 following a lorry I booted my mex not realising that mr policeman was behind doh !! He flashed his blue light and I pulled over, he said thats a very nice car why did you spin the rear wheels ... my answer was it was a little groggy and just clearing it out he asked me if I knew what a section 59 was I said no, never heard of it !!.. he warned me and said next time I am stopped the car would be crushed .. He never took my details ie : name address & dob now having read in to this law the driver and the car are marked on a database .. Its put the wind up me!! what do you guys think am I screwed .!!!..all my previous encounters with police have been great they once towed me to a layby in a squad car when the coil cooked its self .Hell I even let bobby drive it round a field after a car show They have always been nice and interested in it .. ps:I must not drive like a knob ...Oh and quaife atbs are the muts nuts so much fun .. been married to my car for 29 yrs and the wife 15
Mrs O/H/C Posted December 9, 2013 Report Posted December 9, 2013 If no details were taken then he was purely warning you that you could be issued with a section 59. Section 59 is used widely amongst the boy racers and the whole point is to deter from street racing etc.

mk2 mike Posted December 9, 2013 Report Posted December 9, 2013 Take it from me. If he never took your details you're in the clear. Probably just his way of giving you an (Unofficial) warning. For a s59 warning details have to be taken and entered on the computer so other officers are aware a warning has already been issued. Also you need to be given a piece of paper at the time explaining the details of the s59 warning and the consequences of getting caught again. As said the reason for the 59 is to stop anti social behaviour of chavs in saxos in sainsburys car park at 1am. You're safe mate. (Next time just say your foot slipped off the clutch). ;0) 2

antz Posted December 12, 2013 Report Posted December 12, 2013 I got a section 59 for hanging the arse end out of a T junction about 2 years ago. He pulled me over and in the same manner as you got "have you heard of a section 59" and I said no so he said "well you obviously dont"....duh.... Basically I got a letter saying that I had been pulled over and given a section 59 for driving without due care and attention, dangerous driving and not being in full control of the vehicle. It lasts a year on you and the car. If you get another in a year, they take whatever car you are driving off you, if someone else gets one in the car you got one in, they take it off you. From what I gather they just impound it and charge you to get it back. Not sure about crushing it. It only lasts a year though and youre in the clear. Mines expired now so Im good to go. 1

A traffic officer's, or any officer's, job is to enforce traffic law or any other law that he/she witnesses being broken. If you get caught doing burn outs etc on the public road, it's hardly fair to criticise the man who caught you for doing his job just because you're pissed at being caught is it? I've had a few tickets in my time and whilst I was annoyed at being caught, I don't really blame the one who caught me. 2

robo0121 Posted December 12, 2013 Report Posted December 12, 2013 A bit harsh.dont make me laugh.it was nt all that long ago that a member of our armed forces.on the M54 on his way to an unexploded bomb.was caught speeding and prosecutef for it.even though he was on an emergency.it was nt that long ago that an ambulance driver was prosecuted for speeding whilst his blue lights were flashing on his way to an emergency.and it was nt that long ago that a police car on an emergency broadsided an innoccent motorist and wiped him out and walked away not even prosecuted.you get what im saying now...the police are a neccersay evil.respect has to be earnt..dont just come with the uniform......

I'm sure they will do the same for me in a car,red lights and no lights on and a near miss???? Treat all road users the same. 1

It's not the police's fault a cyclist doesn't need a number plate. You also need to consider that a car running a red light may kill someone, a cyclist running a red light however is more likely to kill himself. Police are necessary, full stop. Trust me, you do not want to meet police that are genuinely evil. Plenty of 3rd world countries suffer police forces like that. We, fortunately, do not. But on the other hand don't break the law, especially in a built up area with traffic cams etc around, and you won't be an easy target will you? 1
youngpecker Posted December 12, 2013 Report Posted December 12, 2013 lofl....this was explained to me as a motoring asbo!.My situation was I was following an old gent in a micra doing approx 20 mph in a built up area with his right indicator on.Feeling sure that if I passed the old gent he would probably make the turn right!.after around 100-150 yards he suddenly indicated left and stopped in the road pointing into the shopping square car park.with no reason to stop at all!!.Icould understand it if there were pedestrians crossing but no...I gave a short pip of the horn and put my 407 diesel into first and went around the old git with the slightest spin of the wheels.Bearing in mind I had my two boys in the car (8 and 10 year old)it would have been a little more than that if they were not.I recall seeing a police car in the said carpark unattended! Anyway about an hour later approx fifteen miles away at home my son said there was a policeman coming up the drive and I just laughed thinking he was joking.No it was plod!.on answering the door plod asked me if I knew why he was there! I asked him to enlighten me! He informed me it was about my aggressive driving! he informed me that the old gent (82 year old) was a little bewildered and said he didn't even realise I was behind him.(unaware of his surroundings)and that members of the public had said I was out of order.I explained what had happened but he was not interested in the slightest and on asking where he was when incident occurred he informed me he was in the carpark and witnessed the event! he was probably in the shops getting his bait as there was no hi viz in carpark which he denied ! I also stated frustration was more likely a reason than aggression and asked if he had ticked off the old git for been unaware of other road users!!!His reaction was to promptly issue me with the ticket (already wrote out) and informed me car would be confiscated if I OFFENDED again within twelve months.There is some good uns but the majority of em are bell ends!Anyway the years gone now I can drive like a apple pie again now...

Have a look on your areas police web site there should be a form, but make sure its the DPA you submit not an FOIA enquiry as it wont cover it.

What they should concentrate on are dangerous situations and the berks who drive badly all the time (whoever they are). Most of us can probably drive better in a full-on arse-out than the muppets that complain. A one-off indiscretion should NOT attract anything like an S59, that is simply a draconian knee-jerk reaction. A verbal warning would be fair. How come you can be FINED for driving on the phone (several times) but your car can be crushed for CONCENTRATING while warming up your tyres?? You need to realise that SOME cops are like the old fuddy-duddies who get stroppy when you "dare" to do overtake (or similar) and with those ones you can't win, like a holywood film when everybody's crooked except the hero. We put a lot of time and money into our cars and many of us own them for years and years, we are not likely to risk major dmage unlike the old fools who don't know what's going on around them or the young fools who are to busy trying to look hard to see problems looming. Plus many of the muppets in the Saxo's get away with no insurance, no mot, driving spliffed out etc. And if you have diplomatic plates you can drive around Harrods like a tw4t all day long and nothing can be done about it - go see for yourself if you like watching Arabs trying to drive nice cars. But hey-ho, I always was a grumpy sod! 2
