I have recently been told that I still need to apply for (and show) a tax disc (I have been driving without one since 1995!). When I went to the DVLA website to apply for the disc it obviously stated that the car had been unlicenced since 1995 and that this was an offence that would need to be considered by their continuous licencing section. JUst wondering whether anyone had been in a similar situation. Should I now apply for a tax disc and incur a possible fine or carry on driving as before without the disc - after all I have not avoided paying any duty as the car is tax exempt although I suspect this might not be a great defence if I did happen to be stopped by the police. Trevmk3 Posted July 14, 2009 Report Posted July 14, 2009 not sure mate, but if you do get stopped by the police and you havnt got a tax disc on display will it be worse than if you have a fine to pay ? i wouldnt of thought the DVLA could really fine you for not applying for a free tax disc though but i dont know for sure
Admin Vista Posted July 14, 2009 Admin Report Posted July 14, 2009 SORN wasn't introduced until January 1998 and anything that didn't have a current road fund licence then and hasn't had since wasn't required to be declared SORN. As such and assuming that there's no record of you driving it on the road between 1995 and now, I would apply for a tax disc online and make a declaration that the vehicle hasn't been used on the road. A it naughty but who's going to prove otherwise? The only slight fly in the ointment is that to get a free disk your cars taxation class has to be changed from PLG to Historic vehicle. Have you already done this? If not you'll need to take your V5 to your local DVLA office and apply for a change in taxation class, then you can get your free disc.

Pete you've beed driving the car on the road since you were 3 ? the car isn't tax "exempt" it's just free there's a big differance legality wise, you still need to have it I'd go to a local DVLA centre and just say the cars been off the road since 95 hense didn't need to be sorned as vista says unless they can prove it's been on the road you should be ok but if they had any reports of it on the road you would have had a fine through the door
FredTransit Posted July 15, 2009 Report Posted July 15, 2009 As Vista says, you need to make sure it has Historic on the V5 under taxation class. If it has, there is no point in them pursuing you as there is no duty to collect. As bortaf says, yours is free tax, but you still have to have a disc (party to prove the car has insurance and an MOT, which it should if you have it on the road). As I said I doubt they will fine you, the bit about it being considered by their continuous licensing section is just a standard statement.

It's registered (or built) before 1/1/73 and there's no admin charge, it's free.

It's been a few years since I did it at the PO but as far as I remember it was free there too Yes it is. The last one I did at the PO in December was free. If this is true, I think your mate has been conned. There is no admin charge, nothing. Not through the post (online) or in person at a post office.

Whether or not the tax is free is irrelevant, if the powers that be wanted to do you, they could, and probably would. Do you have the V5 and insurance for said vehicle? If so then it's a trip to Post office maybe, or local DVLA centre, where they will take logbook off you, give you the stub, and new free tax disc. Then you will receive new logbook through the post, with status changed to Historic, with no charge. I did mine about a month ago, after 38 years off the road, no problem at all. 10 minutes or so, and the twit asked me if I wanted 6 months free tax or 12....
