As some of you may know ,i drive a dustbin lorry in Leicester...

 

On tuesday a was issued a ticket...£60 and 3 points ....because my lorry was parked on Zig zag white lines while i was going about my job emptying bins....my loaders empied 4 bins and i was parked there for less than 1 minute (a practise under taken evey week for X amount of years,and not just in that perticular location) ....I never even got out of the truck at any point...

 

...you think i could fight this?....can any one find any exemptions that will allow me to park there because i cant .

 

I personally try not to block a road or hold up traffic where possible but alot of the time i do hold up people for while so dont jump down my throat for doing my job. If your've been held up by us,yes its annoying i know :roll:

 

Any help wil be mucho gratsio :mrgreen: ....

thats bol&*%x dude. those poxy wardens are right jobsworths. i dont know of any way of fighting it but i sympathise as my job driving a school coach has put me in some right dodgy arguements with the fookers round here. when you say what am i sposed to do with a forty foot coach they always answer, not my problem mate. :evil:

i have no idea but to be fair i think that they are well unfair with their decision! You are doing a job for the people and it cant be easy especially down the smaller streets etc!

Fight it if you can mate as seems harsh to me!

Well i've got my boss backing me up...and it was a copper on his own who booked me ..

 

...He never even got out of his car...he signald me to pull over further up the road and then waited for me to go to him...he never asked for any ID,nor did he check my truck or tacho....He was even parked half on the kerb on double yellows... :evil:

 

I shudda tok some pics but didnt think like that till after :roll:

what about the health and safety act? a law that scaffold trucks are using. they can park for long periods of the day where they want (i think) . there has to be something like that concerning dustcarts, surely?. cant see why you got clobbered by the old bill concidering you were only there for a minute. even if it was on zig zags. maybe you had a copper who was a bit bored and wanted something to do. all the best mate, with getting it sorted :thumbsup:

In any other circumstances id of said yeah, your deffo gunna get the points :ykt:

 

 

But as you were only doing your job, id say you can give it a damn good try to fight it :thumbsup: Its not like you were parked there for a great amount of time, and you were still in the vehicle, so even if it was needed to be cleared at that time, you could of easily done so, not like you'd walked off and left it :thumbsup:

 

 

 

 

And im sure that if its a copper on his own, he cant do anything anyhow, as from what i heard, there needs to be another one to confirm what the first ones seen :wink: Not sure if that applys to this, but im sure it applys to speeding :thumbsup:

I think he's got you and you probably won't get anywhere appealing it. The highway code is quite clear on Zig Zag lines and for good reason. If you're stopped on Zig Zag lines then the moving traffic can't see whether anyone is already beginning to cross meaning the pedestrians may step out from in front of your vehicle straight into the path of something moving at speed.

 

I don't think doing your job will suffice as an argument, you'd have been better (and safer from a pedestrians point of view) just holding up the traffic.

 

You MUST NOT park on a crossing or in the area covered by the zig-zag lines. You MUST NOT overtake the moving vehicle nearest the crossing or the vehicle nearest the crossing which has stopped to give way to pedestrians.

is it technically parked? or stopped? two very differant things if you didnt leave the vehicle an it was running i would say stopped but im not the law ive been done for silly offences (fixed penelty no points) in the past an just bit the bullet cos it was cheaper in the long run not to fight it good luck hope somebody sees sence :thumbsup:

I thought that, but unfortunatel the Highway Code also says this...

coppers are w*****s wiv that sort of thing. i had 1 few years back where the overhang behind rear wheels on my escort van,and only the overhang!, was above the zig zags (i.e if touching floor woulda been touching the zig zags) and i was there only a sec and didn't realise. i also got 3 points and a fine :evil:

 

this was 4 days b4 xmas too, what an a******e. what i later found out was that i coulda gotten away wiv it cos he didn't move me off of them to nick me either!

 

from the quotes others have put from highway code looks like u wont get away wiv it, however u might possibly get the points dropped and just have an increased fine, due to the circumstances in ur case. at least thats what a friend of mine thinks but he's not qualified to say so, just knew of a similar thing (tho not zig zags) happenned to someone else.

Surely you are allowed to stop if someone was stood or crossing there?

 

That's stopping in the road though, which blocks other traffic. Stopping at the kerb is not the same thing.

Well i got sent home today.

I havent felt right since the incident and told my boss i shouldnt be behind the wheel of a HGV because my mind isnt on the job.

 

I know its only 3 points and £60.....but thats not the point ....the fact that i choose to be hard working and law abidding....i have never been in trouble or arrested or anything of the sort.

 

In my eyes i have still done no wrong and yet im being penilised for it and theres not alot i can do about it ... Thats the thing that is really starting to fook me off :evil::evil:

 

The thought of it going round in my head and i cant shake it off..i've also had 2 bad dreams and not slept well...

 

I feel daft for being this way over a trivial matter .... but sometimes you cant help the way you feel inside ..

 

And no...sinking afew :beer: probably wont help :roll:

From what I read, he stopped you further up (didn't move you on, you moved off of your own accord) so has the ticket been issued legally? Was he alone? Even if so, neither were you. Is there CCTV at the crossing? You could say you dropped off the loaders, if it shows you stopped. It sounds a lot like it's his word against yours. Remember, even speeding tickets are not 100% in their outcome. Remember you are driving professionally and the points may affect your license and therefore your job. Sorry if this upsets you further, but I can't see how contesting this would make it worse.

The copper was sat behind us while we emptied 4 bins and then he pulled up next to me and said " pull over up the road so i can have a word "

 

...I been back into work today and me and the boss were reading up on how we gonna win this...

 

...Apperently its up to the local council to decide who has exemptions to park on the roads around Leicester.....

 

..Because we are contracted by said council to empty household bins ,my boss will ask the council if we are exempt from parking restrictions on zig zag lines ...if they say no ..my boss will have to refuse to empty the bins because of the legalities ( council wont like that )...and if they say yes we can park there, well then im off the hook :wink:

thats the route i would go. they will have to send out a pickup for those bins or stop smack bang in the middle of the road. i drive 8wheel roro lorrys and no one is on our side. good luck and keep us informed :thumbsup:
