Mrs O/H/C Posted September 19, 2011 Report Posted September 19, 2011 A man has been arrested for murdering a burgular ...he was at home when 2 men entered the house to steal. The homeowner stabbed one of the robbers and during this ordeal his wife and child came home. He has said that this was an act of self defence as he was protecting his home and family. So..should he be prosecuted for comitting a murder ? Or..should he be let free for protecting his life and that of his wife and child ? Please Discuss .......

It doesn't say he's been charged with murder yet does it. I lie somewhere in the middle ground. i.e. if someone breaks into your house and you fear for your safety or the safety of your dependants, then let the twats have it and with both barrels.......... BUT if said burglar has already left your house, you are unmolested and are now safe, then giving them/him/her both barrels in the back while they run away is simply a revenge attack and should be punished as such. No-one is above the law. It's for that very reason that Tony Martin went to jail for murder. He was not defending himself or his property, he shot that kid in the back purely out of malice. The kid deserved to be punished by the law and go to jail, he didn't deserve to die.

In a way he's doing a better job than the courts/prisons we have in the UK, one less person stealing from others to worry about...

The first is defensible, the second possibly not. Additionally, what did he shoot them with? Possession of a firearm of any kind has to be legal or he won't have a leg (no pun intended) to stand on.

As far as I'm concerned if some thieving scum bag fooker has broken into your house or invited themselves in for questionable reasons ie. to nick what they can, then they deserve everything they get Probably not the right answer but that's my opinion

Sure if your life or your dependants lives or safety are a threat then yes. But because they're hot footing it down the drive with the keys to your Audi? No.
mk2harrier Posted October 7, 2011 Report Posted October 7, 2011 i agree with you to an extend Scott, and as an ex forces guy you will also know about rules of engagement, endangering life and property; shooting someone in the back whilst they run away is a definate no no, but apprehending that person without endangering yourself or others is perfectly acceptable, if the criminal is wounded in the proccess then that is their tough luck; and if that person recieves a fatal wound while you defend yourself or others or property you should never be penalised for it unless it is malicous which i highly doubt in most situations.
