sambo Posted August 24, 2007 Report Posted August 24, 2007 Here's my contribution to this thread... What a King knob head!! Does he seriously expect you to pay up??? You buy a car privately, you test drive it and your responsible for it as soon as you hand the cash over. Full stop. Now if he had only got 10 yardds down the road, i could see maybe where he is coming from but he drove 20 miles! Anyway, what is the specific fault? he said the drive shaft broke!? fooking knob.
Doc Posted August 24, 2007 Report Posted August 24, 2007 next one . he can phone my number i court and ill answer that phone is registered to me plus the call times i got proof via nhs that i was in a class at that time . or am i just worring . trust me your not getting away with this, im being nice about this now i have had the car in to a garage today and they have told me the car isn't road worthy hense why i'll be taking legal action ive only asked you for the recovery costs if i take action against you it will be for the repair bill as well im being more than resonable about this only asking you to pay the recovery costs and you say it will cost me more getting a solicitor it wont because with the garage backing me up that the car isn't road worthy and me taking it to small claims court you haven't got a leg to stand on (as the loser pays costs as well), as well as me being able to show you were deceptive about the deal giving wrong phone number details on more than one document. as ive said im only asking for the recovery costs if you want me to go for the whole lot thats fine by me. Mate the car was sold in good faith and in laws eyes its caveat emptor which means ....let the buyer beware . He has no comeback on you for the recovery as he could have hit a kerb driving home and wrecked the driveshaft how would you know . If it had an MOT its roadworthy and if it was a recent MOT then his argument is with the MOT station . If it ends up in small claims court ill pop down with you mate . Itll cost him more than its worth to do it so if he gets a report on the vehicle tell him that you have a specialist that wishes to inspect the vehicle for your legal team and that it will need to be transported at his cost to a location far anough to make it unviable Im a dab hand at this legal malarkey Ignore him theres nothing he can do .
Burns Posted August 24, 2007 Report Posted August 24, 2007 just tell him that the car doesn't have driveshafts, job done
beedz Posted August 24, 2007 Report Posted August 24, 2007 my thoughts (other than he's just a nob trying to rip you off) for what it's worth, just reply with: i have taken advice regarding this matter, and have a number of points and quetions to clarify prior to proceeding further: the vehicle does not have driveshafts the vehicle does have halfshafts, if these are the item under discussion please confirm (it is worth noting that should these have failed the vehicle would simply have lost drive, and would not have resulted in a dangerous loss of steering or braking). you state you have already had the vehicle repaired, please provide copies of the billing details and documentary evidence of the failed items. you state the AA recovered the vehicle and this resulted in a bill of 311, please provide a copy of the billing details along with the technician's inspection notes. you state that you have been informed that the vehicle was not roadworthy, please provide the details of the independent inspection facility, and a copy of the report. I am sure you will agree that these are entirely reasonable requests, and I look forward to an agreeable conclusion for both parties. hope it helps mate
OllieC Posted August 24, 2007 Report Posted August 24, 2007 i'm sorry you have to put up with this nonsense ken i'm certainly gonna write a receipt out for any cars i sell in the future best of luck mate, i'm sure you wont end up out of pocket for it

over_head_cam Posted August 25, 2007 Report Posted August 25, 2007 Every car I buy seems to have a fault that develops shortly after I get it. It's my car - my problem

It's my car - my problem exactly!! when i got my car on the way home it was really odd, just put it down to me not bein used to it, got it to a ton on the motorway still tho, got it home took it for a service, only runnin on 3 cylinders...LOL a ton on 3 cylinders!! gotta love it!! some people dont realy get private sales do they, if they want a warrenty, go to a dealership!! good responce tho Ken, very well worded, hope thats the end of it and hope he doesnt try to mess you about anymore!!
Admin Vista Posted August 25, 2007 Admin Report Posted August 25, 2007 Good reply, but what happens if he calls your bluff and produces everything you've asked for? I think you need to be sure of your position as even if he hasn't a leg to stand on, he could become a right royal pain for you.
