Firstly sorry as this has probably been covered and answered Many times recently but, 

My mot ran out 11th May 

I looked to see about registering it as exempt today and from what I've read on the gov website

You only 'register' it vhi when taxing it. 

Mine automatically retaxed itself thanks to gov website 1st may 

You dont need to apply to be mot exempt it said? 

No forms, no waiting on some long winded phone line for ages..... Just hand a bit of paper to the old girl behind the counter when taxing it? 

If your mot runs out before your tax, just wait until retaxing to declare vhi 

That seems to easy to me??? 

Have I missed something?

Well clearly the left hand doesn't know what the right is doing ! I got got my tax renewal through the other day although free and mine is clearly over 40 yr old  but still states it requires an MOT.

you will probably find Colin, it was printed too early, the V112 wasn't updated till Friday the 18th and put on the site the same day

I think you have a trip to the post office, with your V112 and V5 for first MOT exemption regardless, its only subsequent ones that you do online (I'm sure I read that somewhere)

Yea I downloaded the form v112 an it says when taxing your vehicle, but I don't need to til next may so from how I read it, I don't need to do anything to say it's mot exempt til then?

if it were me, I would be trying to find out, as I the way I read it, if its not registered as vhi, then driving without an MOT is still an offence, ie, its not mot exempt until you register it as such, therefore you still need an mot till its next up for taxing, or sorn it, then re tax it registering as a vhi, but that may lumber you off the road for a small amount of time

Well so I didn't end up getting pulled by the police I just rang DVLA and ask them she said between the 11th of May and yesterday I wouldn't have been able to use my car due to having no MOT but as of today it is MOT exempt and I do not need to re tax the vehicle to declare it so, as its over 40 years old, next year when my tax is up for renewal it will prompt me to confirm that it is a vhi,

I asked even though my MOT expired on the 11th I can definitely use it today without worrying about the MOT she said yes as long as it's in a roadworthy condition

By the sounds of it the v112 form is only for the post office as when they go to check the details to tax your vehicle it will say no information available the same as it does now if I do a MOT check on the government website it shows my tax is ok MOT information not available

read the title of the V112

it says, Declaration of exemption from MOT (V112)

you have to submit the form to the post office when taxing the car, they send the form to the dvla, you get your tax disc and are covered at that point, until that point, you need an MOT, and a good part reason Colins tax reminder still says he needs an MOT, as it has not been registered as VHI yet

by signing and submitting that form, you are also confirming the vehicle has not been radically altered as per their guidelines

that's my understanding of it, personally I would double check with the local constabulary

on another note from your post, if your MOT has only just run out, then it should come up as that when checking on the government site

I'll still be getting mine MOTd as someone stuck a big lump in the front and changed the steering and brakes ! TBH the cost of an MOT is cheaper than a life! It's always best to have a third party put it up on a lift and have a good check over. Bloody silly concession if you ask me.

Here's an extract from the latest issue of FBHVC news that I will shortly be emailing out copies of to paid members. Seems pertinent to the point you're making and clarifies that providing the vehicle is not radically altered, it can continue to be used legally without an MOT and no declaration having been made. If it has been so altered however, the Owner should MOT the vehicle as normal.

Following discussion with a representative of DVSA, a process has been identified whereby the keepers of vehicles qualifying as VHIs, who are under the law entitled to be exempt, will not be obliged to take what would legally be a voluntary MOT test just to escape possible enforcement based upon the DVLA record.

• The DVLA record will pick up, by reference to the date of first registration, when any vehicle which might qualify (i.e. not an HGV or a bus or coach in commercial use) becomes over 40 years old.

DfT have to date said they do not intend to promulgate the existence of this procedure, but there seems no reason why the Federation should not make our members aware that the keeper of a qualifying vehicle over forty years old is not, from 20 May, at risk of prosecution for failure to take an MOT until the next re-licensing date. However, the Federation would obviously advise that if the keeper of a vehicle considers that he will not be able to make the required declaration that the vehicle is a VHI he ought to have a valid MOT certificate, atthe latest before the re-licensing date for the vehicle arise

Soooooo........ 

Does that mean the same as what the DVLA told me, its over 40, we know it is, so you don't need a MOT an it's already taxed so don't worry about sorn and retaxing the vehicle to declare its vhi, but I'll need to declare it next tax date?

So just in case anyone is still hovering round here, 

I went into the post office the other day and asked their advice

The lady said no the v112 is just for our staff, we Dont send It off or put anything into the DVLA system, then her manager was ear wigging in the corner and comes over and confirms the DVLA already have vehicles listed, the v112 is to declare to the staff at the post office you're taxing your vehicle at that it meets the criteria for exemption, no mot needed so they can tax it, no DVLA involvement, no forms sent off, no extra box ticked on the computer. 

So now the cars out the garage an I feel safe that the fuzz won't pull me an tell me off!

I once knew someone who would pull you by the fuzz and give you a slap for a small fee.......?

well, I have just come back from the post office after taxing mine as MOT exempt, and the lady behind the counter as she was scanning the reminder, said they send the V112 to the DVLA, I queried it, having read this post, she then showed me the special postal bag she has to put them in, that when full or at week/month end, gets sent to the DVLA
