sambo Posted November 25, 2006 Report Posted November 25, 2006 I got a little bored whilst waiting for some friends to come round last night, so i thought i'd go for a little thrash in the escort. Drove down town and there was loads of people about cos it was late night shopping or something, anyway i pull out of a junction and turn right, carry on down the road for about 300 yds until i get to a little roundabout. Nothing abnormal there. I pull away from the roundabout and a little way down the road, a police car shows up behind me flashes his lights and sh1t. I sit in the car wondering what i had done wrong and the officer tells me to get out of the car and stand on the pavement. He says "do you know why i pulled you over?" and i honestly havent a bloody clue, so i say "car too loud?" Turns out i did a wheelspin whilst pulling out of the roundabout? I didnt even know i did it. The copper said that it was a tiny one but he's gonna do me for a section 59 anti-social behaviour act or something?? What a apple pie. He tells me if i get pulled for the same thing they can and will take my car from me!! All this just cos i did a "little" (by his own admission) wheelspin. The ground was slightly wet and its a light RWD tuned car. My bloody girlfriend accidentally does wheelspins sometimes in her ford KA! Talk about the old clique about them not having anythiong else better to do! I could understand it if i was driving sideways like i normally do but i thought that theres too many people around! Basically he pulled me just cos my car is loud and (better than his) . tinker lol! What a load of arse. Here's the section 59: Seizure of motor vehicles 59 Vehicles used in manner causing alarm, distress or annoyance (1) Where a constable in uniform has reasonable grounds for believing that a motor vehicle is being used on any occasion in a manner which- (a) contravenes section 3 or 34 of the Road Traffic Act 1988 (c. 52) (careless and inconsiderate driving and prohibition of off-road driving), and ( is causing, or is likely to cause, alarm, distress or annoyance to members of the public, he shall have the powers set out in subsection (3). (2) A constable in uniform shall also have the powers set out in subsection (3) where he has reasonable grounds for believing that a motor vehicle has been used on any occasion in a manner falling within subsection (1). (3) Those powers are- (a) power, if the motor vehicle is moving, to order the person driving it to stop the vehicle; ( power to seize and remove the motor vehicle; © power, for the purposes of exercising a power falling within paragraph (a) or (, to enter any premises on which he has reasonable grounds for believing the motor vehicle to be; (d) power to use reasonable force, if necessary, in the exercise of any power conferred by any of paragraphs to (a) to ©. (4) A constable shall not seize a motor vehicle in the exercise of the powers conferred on him by this section unless- (a) he has warned the person appearing to him to be the person whose use falls within subsection (1) that he will seize it, if that use continues or is repeated; and ( it appears to him that the use has continued or been repeated after the the warning. (5) Subsection (4) does not require a warning to be given by a constable on any occasion on which he would otherwise have the power to seize a motor vehicle under this section if- (a) the circumstances make it impracticable for him to give the warning; ( the constable has already on that occasion given a warning under that subsection in respect of any use of that motor vehicle or of another motor vehicle by that person or any other person; © the constable has reasonable grounds for believing that such a warning has been given on that occasion otherwise than by him; or (d) the constable has reasonable grounds for believing that the person whose use of that motor vehicle on that occasion would justify the seizure is a person to whom a warning under that subsection has been given (whether or not by that constable or in respect the same vehicle or the same or a similar use) on a previous occasion in the previous twelve months. (6) A person who fails to comply with an order under subsection (3)(a) is guilty of an offence and shall be liable, on summary conviction, to a fine not exceeding level 3 on the standard scale. (7) Subsection (3)© does not authorise entry into a private dwelling house. ( The powers conferred on a constable by this section shall be exercisable only at a time when regulations under section 60 are in force. (9) In this section- "driving" has the same meaning as in the Road Traffic Act 1988 (c. 52); "motor vehicle" means any mechanically propelled vehicle, whether or not it is intended or adapted for use on roads; and "private dwelling house" does not include any garage or other structure occupied with the dwelling house, or any land appurtenant to the dwelling house.

LUKE261 Posted November 25, 2006 Report Posted November 25, 2006 I HAD ONE OF THOSE BEFORE MATE FOR DOIN A WHEELSPIN IN MY nova wot a load of shite, i got a £30 fine and a section 59 about 3 years ago and its changed now it used 2 just be on the car so you could drive another car and get another section59 and it didnt matter but now it goes on the bloody driver aswell!!

IMHO It's cases like this that do little for maintaining the police forces standing in the eyes of the general public.

Stupid people blocking junctions because they didn't think that the lights would change and they couldn't move. Wound me up a bit, and did spin my wheels a couple of times cos I needed to be somewhere and I was late.

What a tw@t! the more i think about it, the more is annoys me that some knob with nothing better to do can do that. I will go to the police station soon and pick up my form with all the details on it cos i dont know how long it lasts for??

I absolutely 100% agree. I can't believe this, most of you know that im a Traffic Cop and I have never given a Sect 59 warning.... If someone is driving like a prat then I would have a word and try and teach them a little bit about the danger that they are putting themselves/passengers/other road users in. If there driving is that bad, then report them for dangerous/careless driving. I would rather spend 10mins of my time having a chat with someone, then filling out forms, my job isn't about sticking everyone for any little offence I could find, I see it more as education of drivers, be it wearing a seatbelt to driving like a loon. Oh and yes I have worked with some Police Officers who will give out a ticket for anything... even holding a sandwich in one had whilst driving, i mean come on, the offence there is being not in proper control, so yes if they were driving all over the road, then fair enough, but if you are driving in a straight line with no problems then why give out a ticket... I was probably the worst offender when I was 17-20, driving like a prat, its a wonder I wasn't killed, so I would feel like a hyporcrite if i did everyone for any little offence, Sorry for my little rant, it just really annoys me that people get done for stuff like this, when other things could be said at the time, now you have to live with the thought that for the next 12 months, you can't be stopped for any offence that is likely to cause alarm/harrasement/distress, otherwise they will pull your car off you... and it will cost you, in Kent anyway £105 to get it back, plus £12 a day storage costs.
